TERMS + CONDITIONS

Important: Please read these Terms and Conditions carefully before using this website or purchasing any products or services. We recommend you print or save a copy for future reference.
1. About These Terms
1.1 This website (www.northstudioleeds.co.uk) and the products and services displayed on it are provided by R Nation Limited (“we”, “us”, “our”).
1.2 When we refer to “you” or “your”, we mean any user of this website, purchaser of goods, or participant in our classes or services.
1.3 These Terms set out the conditions under which you may access and use our website, book or attend classes, or purchase memberships or goods from us.
1.4 By using this website or purchasing any goods or services from us, you agree to be bound by these Terms. If you do not agree, you must not use our website.
1.5 We may update these Terms from time to time. The latest version will always be published on our website and will apply from the date of publication.
1.6 If you have any questions about these Terms, please contact us via the details provided in section 25.
2. Definitions
In these Terms, the following expressions have the meanings given:
“Class” – any exercise class or session provided by us at a North Studio location.
“Client” – a user of our website, purchaser of goods, or participant in classes or services.
“Credit” – a unit purchased via our website or studio that allows booking into a Class.
“Membership” – a rolling monthly subscription giving access to a set number of Credits and benefits.
“Membership Fee” – the monthly payment associated with a Membership.
“Minimum Term” – the first three (3) months of a Membership, during which cancellation is not permitted.
“User Account” – your registered account on the Mindbody platform through which bookings and payments are managed.
“Website” – www.northstudioleeds.co.uk.
3. Eligibility and Studio Use
3.1 All clients must register for a User Account before booking or attending any Class.
3.2 You must be at least 16 years old to attend a Class. Clients aged 16–17 must have written parental/guardian consent and complete a safety induction before attending alone.
3.3 We may refuse entry or terminate your Membership or use of our services if your behaviour breaches these Terms or disrupts other clients or staff. No refund will be issued in such circumstances.
3.4 All instructors, timetables and classes are subject to change without notice.
3.5 You must comply with all posted studio rules, safety instructions and staff directions at all times.
4. Health and Waiver
4.1 Our staff are not medically qualified. You are responsible for ensuring that you are physically and mentally fit to participate in any Class or activity.
4.2 All clients must complete and sign a Health Waiver and Release Form before participating in any Class.
4.3 By attending any Class, you confirm that:
a) you are in good physical condition and know of no medical reason why you should not participate; and
b) you understand and accept that exercise carries inherent risks of injury.
4.4 You participate entirely at your own risk. We accept no responsibility for any injury, illness, accident or health condition arising from your participation, except where directly caused by our proven negligence.
5. Credits
5.1 Credits can be purchased individually or in bundles (“Class Passes”) via our website or in-studio.
5.2 Each Credit entitles you to attend one Class unless otherwise specified.
5.3 Credits have fixed expiry dates depending on the package purchased. Expired Credits cannot be used, extended or refunded.
5.4 Credits are non-transferable and non-refundable under any circumstances, except where required by law.
5.5 We may occasionally offer promotional Credits or discounts at our discretion. These are subject to availability and specific expiry terms stated at the time of purchase.
6. Cooling-Off Period (Online Purchases)
6.1 If you purchase a Membership or Class Pass online, you have a legal right to cancel within 14 days from the date of purchase (“Cooling-Off Period”) under the Consumer Contracts Regulations 2013.
6.2 To cancel, contact us by email at info@northstudioleeds.co.uk or in person at our studio.
6.3 If you have used any Credits or attended any Classes within the Cooling-Off Period, the value of those sessions will be deducted from your refund.
6.4 After the Cooling-Off Period, no refunds will be issued under any circumstances (see Condition 9.7).
7. Booking Classes
7.1 Classes must be booked in advance via your User Account.
7.2 Bookings are subject to availability and allocated on a first-come, first-served basis.
7.3 If a Class is full, you may join a waitlist. Should a space become available more than 2 hours before the Class start time, you will be automatically added and notified.
7.4 If we cancel a Class, the Credit used will be automatically refunded to your User Account.
7.5 You must arrive at least 5 minutes before the scheduled start time. Late arrivals may be refused entry and treated as a “no-show”, and the Credit will not be refunded.
8. Cancellations and No-Shows
8.1 You may cancel a Class booking up to 12 hours before the start time to receive an automatic Credit refund.
8.2 Cancellations made less than 12 hours but more than 2 hours before the Class start time will only be refunded if the Class is full at the start time.
8.3 Cancellations made within 2 hours of the Class start time, or failure to attend (“no-show”), will result in loss of the Credit.
8.4 Special workshops or events may have different cancellation periods, as stated at the time of booking.
9. Memberships
9.1 All Memberships have a Minimum Term of three (3) months from the Joining Date.
9.2 After the Minimum Term, Memberships continue on a rolling monthly basis until cancelled.
9.3 To cancel after the Minimum Term, you must give at least one (1) month’s written notice before your next billing date.
9.4 Memberships may be frozen for one billing period at a time by providing at least 48 hours’ notice before the next payment date. Memberships can be frozen a maximum of two times per 12-month period.
9.5 Membership Fees are collected monthly in advance by debit or credit card on the same date each month (“Payment Date”).
9.6 If payment fails, we will notify you by email. If payment is not made within 48 hours, your Membership and any active bookings may be suspended or cancelled.
9.7 Refund Policy: Except for valid cancellations within the Cooling-Off Period (section 6), all payments are non-refundable under any circumstances, including but not limited to illness, injury, relocation or unused Credits.
9.8 Unused Membership Credits expire at the end of each billing period and cannot be carried over or exchanged.
9.9 Membership Credits are non-transferable.
10. Prices and Benefits
10.1 All prices are listed on our website and may change from time to time.
10.2 We will give at least 14 days’ notice of any increase to Membership Fees.
10.3 Any benefits or partner discounts associated with Memberships may be amended or withdrawn at our discretion.
11. Goods
11.1 All goods sold in-studio are subject to the Consumer Rights Act 2015.
11.2 We warrant that goods will be of satisfactory quality and fit for purpose.
11.3 If you wish to return a product, it must be unused, in its original packaging, and returned within 7 days with proof of purchase.
11.4 This does not affect your statutory rights. Refunds will not be provided for used or damaged goods.
12. Personal Belongings
12.1 You are solely responsible for your personal belongings while attending any Class or at our premises.
12.2 We do not accept liability for loss, theft or damage to your property, except where caused by our proven negligence.
13. Use of Our Website
13.1 You may use our website for lawful purposes only.
13.2 We do not guarantee that the website will always be available or error-free.
13.3 You must not introduce viruses or attempt unauthorised access. Breaches may be reported to law-enforcement authorities.
13.4 You may download or print material for personal use only. All intellectual property rights remain owned by us or our licensors.
14. Data Protection
14.1 We process personal data in accordance with the UK GDPR and the Data Protection Act 2018.
14.2 Our Privacy Policy and Cookie Policy form part of these Terms and are available at www.northstudioleeds.co.uk/privacy-policy.
14.3 We use the third-party platform Mindbody to manage bookings and payments. By using our services, you consent to your data being processed in accordance with Mindbody’s privacy practices.
15. Liability
15.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud.
15.2 Subject to that, we are not liable for:
a) any indirect, incidental or consequential loss;
b) any loss of profits, goodwill or data; or
c) any injury, illness or accident resulting from your participation in any Class, unless caused by our negligence.
15.3 Your statutory rights as a consumer are not affected.
16. Complaints
16.1 If you are dissatisfied with any aspect of our services, please contact us at hello@northstudioleeds.co.uk. We aim to respond within 14 days and resolve issues promptly before formal action is taken.
17. Variation
17.1 We may revise these Terms at any time. Updated versions will be posted on our website and take effect immediately upon publication.
18. Severance
18.1 If any part of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
19. Third-Party Rights
19.1 No person other than you or us shall have any rights to enforce any term of these Terms under the Contracts (Rights of Third Parties) Act 1999.
20. Governing Law and Jurisdiction
20.1 These Terms are governed by the laws of England and Wales.
20.2 You and we agree that any disputes shall be subject to the non-exclusive jurisdiction of the English courts.
20.3 If you are a resident of Scotland or Northern Ireland, you may also bring proceedings in your local courts.
